Terms of Auction
Please review the following Disclaimer and Terms and Conditions of this Auction. By placing a bid in this auction constitutes your acceptance and agreement.

• Both people participating in the experience/trip must be 21 years of age and older.
• This auction does not include any food, accommodation, transportation outside or within Hawaii, or travel related costs not specificially detailed in the above description.
• Both participants must hold a valid passport, visa and/or other documentation, and be eligible to travel. Starting on January 23, 2007, all air and sea travellers from Canada, Mexico, Central and South America, the Caribbean and Bermuda, will be required to present a passport to enter or re-enter the United States. This includes children of all ages. Please ensure you have the correct documentation when travelling, as failure to produce a passport will result in denial of boarding and/or entry to the United States.
• It is the winning bidder's responsibility to arrive at the airport 2 hours in advance with proper documentation and identification as required by the airline and both Canadian and U.S. authorities. Both travelers will be booked on the same outbound and inbound flights. Winners are responsible for all taxes, fee's and surcharges. The individual booking the flight must be over the age of majority in their province or state. Flights must be taken as offered and extensions to the noted departure/return time and dates are not permitted. No changes to travel dates, times or passenger names are permitted once booked. If you miss your flight or for any reason can not take the scheduled flight, it is your sole responsibility (and cost) to make alternative arrangements.
• The hotel room will be a standard room. The hotel will be prepaid and reserved under your name. You will be required to show valid picture identification upon check-in. You will also be required to have a valid credit card for a security deposit. All damages to the room, room service, all incidentals, and any additional charges are the responsibility of the winning bidder and are to be paid directly to the hotel prior to check-out.
• Participants under the age of 21 may not be able to enter the Tailgate Party.
• The winning bidder is responsible for securing their own insurance on this item, including but not limited to cancellation insurance. As this is a scheduled, once in a lifetime event, no refunds will be issued for unused tickets.
• This auction is for the above mentioned items. No changes are permitted. You will not be permitted to change or extend the flights or hotel stay.
• Upon close of auction, the winning bidder will be contacted by a representative of the seller for complete contact information of the two participant for travel and hotel arrangements. It is the winning bidder's responsibility to reply with complete information within 24 hours from receiving the request in order to allow enough time to make appropriate travel reservations. The seller will provide the airline the names and contact information of the participants to the airline for the airline tickets and to the hotel. Both the airline tickets and the hotel room are presently booked/reserved however require the participants names and contact information in order to be used.
• The game tickets, tail gate party information, and the swag bag will be waiting for you at the hotel upon check-in. You will be sent airline confirmation in advance of departure from the seller or the airline directly.
• Accepted methods of payment are PayPal, money order negotiable in Canada, certified cheque negotiable in Canada, and cashier's cheque.
• Payment is required in full within 3-days from end of auction. Failure to make payment within 3-days entitles the seller to offer the item to the next highest bidder.
• No sales tax will be charged on the winning bid amount.
• As you are receiving an item in exchange for your payment you will not receive a charitable tax receipt. Please consult your tax advisor for full information and details.
• AuctionJAM Inc, the auction management agency, is performing an auction management service on behalf of and at direction of the selling party. AuctionJAM Inc, its partners, clients, are not responsible for any errors or omissions or for any warranties or guarantees either explicit or implied herein.
• This auction prize must be taken as offered, and is neither transferable nor redeemable for cash. This prize can not be sold, in the event that it is, the entire prize package is void.
• By placing a bid on this auction you indemnify, hold harmless and release AuctionJAM Inc, SickKids Foundation, NFL, WestJet, their respective advertising and promotional agencies, and their officers, directors, subsidiaries, joint ventures and employees from claims, demands and damages (actual and consequential) of every kind and nature, know and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of, resulting from or in any way connected with the auction item. Furthermore you fully release all parties associated with conducting this auction from any personal injury, property damage, any loss and all costs sustained or incurred as a result of the use of the auction item or experience.
• SickKids Foundation will receive 100% of the winning bid on this item. The winning bidder will receive, in exchange for payment of the full bid price; the item described herein, all documentation under the terms described herein.
• All bids are legally binding and enforced.
• In some cases you may view the auction from country specific eBay website which will display the auction item in a local currency. All payments must be made in Canadian or US dollars.
• This item is sold 'as is' and 'where is'. This auction does not include any items or services that are not detailed above.
• The seller reserves the right to block a bidder or cancel any bid at any time for any reason including but not limited to, feedback, non-paying bidder status, bid retractions, and recent bid history. Furthermore if the seller determines that for any reason the auction is not capable of running as originally planned or the integrity of the auction has been compromised for any reason, the auction may be cancelled or ended early without notice and without any compensation.
• Your participation by placing a bid in this auction constitutes your acceptance and agreement to these terms and conditions as well as all additional conditions which may be set out on additional pages associated with this auction.
